Does E-Verify Check Criminal Background?

Criminal background check is a common requirement in many employment types and for many organizations (specially the regulated ones) it can be a regulatory or legal requirement to perform a criminal background check before they are hire individuals on certain positions.

While all the employers in the United States are required to perform I-9 eligibility verification, for most businesses background check E-verify process is voluntary. However, for federal contractors, it is a mandatory to background check E-verify.

E-Verify Process

E-Verify process begins with creating a case on the E-verify system with the help of information obtained from the employee’s form I-9. Once the case is created, the E-verify system search through the records stored in the database and the result is displayed.

The E-verify background check is performed after an employee has accepted the position and joined the organization. However, background check E-verify should be performed within three days since the date of joining.

Following are the different types of case results that can be shown after performing the E-verify process:
Employment authorized

This case result is displayed when the records available to SSA and/or DHS completely matches with employee’s information provided on form I-9.

Verification in process

When the case is referred to DHS in order to perform further verification, “Verification in Process” is displayed as the case result.

Tentative non confirmation (TNC)

This case result is displayed when SSA and/or DHS records do not match with the employee’s information. However, since it is a “Tentative Non confirmation” additional action is required.

Case in continuance

This case result implicates that that more time is required conclude the case for a final result.

Close Case and Resubmit

This case result is generally displayed when the information on the employee’s documents is incorrect. In this case, the employer needs to close the case and create a new one for that particular employee.

Final non confirmation

This case result is displayed when the employee’s employment eligibility cannot be confirmed by E-Verify after the employee visited SSA or contacted DHS.

How Long Does E-Verify Take?

E-verify process does not take more than a few second to verify the employment eligibility after creating a case on the E-verify system.

Some cases, however, may take longer as they may require additional actions.

E-Verify Self-Check

Federal E-verify program allows employers to quickly check employment eligibility of new hires with E-verify process. However, E-verify is not limited only to employers. If an individual wants to know his/her employment eligibility in advance, he/she may do so with E-verify self-check.
